The officer’s goals is to justify arresting you, so if you refuse they will have grounds to take you down to the station for a blood test. But, there is no way you would have convinced them you are not drunk by the sobriety test.

No. 4 — Don’t Blow

Don’t submit a sample of your blood or breath, especially if this is your first offense. Throughout my career as a lawyer I have had a consistent “Don’t Blow” policy. Even though testing has become more stringent and an officer can receive a warrant to get your sample. Nevertheless, these tests and the results they produce are subjective to interpretation. A skilled lawyer will still make a strong case in your favor, especially if you carefully observe the next rule.

No. 5 — Remain Silent

You do have the right to keep quiet and not make your situation any worse. Law allow you to hold your peace to avoid saying anything that can be misinterpreted as a confession or anything that can make you seem guilty. This is an important right and can keep you from serious consequences. Be careful as an officer may say something to the effect of you not having this right and asking you again to answer this or that question. Politely and respectfully refuse to speak again. They are not allowed to force you to speak and can’t. Do not waive your right by beginning a “friendly” conversation with the officer or even the evidence technician. Be careful what you say on the phone, to your passenger or even passing motorists. Always assume you are being videoed and voice recorded.
